Personal injury cases can arise from numerous situations, but our clients concerns often involve injuries incurred as a result of a car accident, injuries sustained as a result of property that isn't properly maintained (falls caused by slippery or dangerous conditions, for example), and injuries that result from improper work conditions (poorly maintained machinery, repetitive motion stress, dangerous work conditions, etc.)

      In addition, personal injury claims can involve medical or professional negligence. A person injured as a result of negligence in a medical setting might, for instance, have a claim against the health care providers if it can be proven any resulting injury can be attributed to that negligence. Likewise, injuries caused by defective products, or work that reflects a lack of professional standards, can also often involve actionable claims of this nature.

      In all of these cases, a claim has two basic parts: liability and damages. The liability issues relate to the proof that the injury was caused by the negligence of another party, or the defect in the product being used. The damages relate to the extent of the injury, the type of medical treatment needed in the past and future, the resulting medical expense, the impact of of the injury on the person's ability to work and engage in recreational activities, and other results of the injury.

      The role of an attorney in assisting an individual with a claim of this type is to gather the information, evaluate the claims, to provide the client with an assessment of applicable legal issues, liability possibilities, and potential damages that might be proper -- and to present that information in the most logical and understandable manner possible. The attorney then counsels the client in negotiations, which may occur first with an insurance company, or they may be strictly between attorneys representing various parties. Most cases can be settled with the aid of the attorneys, meaning the parties reach and agreement between themselves. Some cases cannot be settled and proceed to trial.
